Terms of Service

1. The Agreement

By downloading or using SkillStack, you agree to these Terms. If you are using the App on behalf of a company, you represent that you have the authority to bind that entity to these Terms.

2. License to Use

We grant you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the App. This license is for the sole purpose of enabling you to use the services provided by SkillStack in the manner permitted by these Terms.

3. Intellectual Property (IP)

Our Content: All software, design, logos, and "base" AI models within the App are the exclusive property of Bisaria LLC and its licensors.

Your Content (Input): You retain ownership of any text, images, or data you upload or "prompt" into the App. By providing Input, you grant us a worldwide license to host, store, and use that content solely to provide the service to you.

AI Output:

  • Ownership: To the maximum extent permitted by law, we assign to you all our right, title, and interest in the results generated by the AI based on your Inputs ("Output").
  • Non-Uniqueness: You acknowledge that because of the nature of machine learning, Outputs may not be unique across users. Other users may provide similar prompts and receive the same or similar Output.
  • Copyright Warning: Current laws (as of 2026) may limit your ability to claim copyright over purely AI-generated works. We make no guarantee that Outputs are protectable by intellectual property law.

4. AI Specific Disclaimers

  • Accuracy: AI can "hallucinate" or provide inaccurate info. You are responsible for fact-checking any Output before relying on it for professional, medical, legal, or financial purposes.
  • No Professional Advice: The App is for informational/entertainment purposes. It is not a substitute for professional advice.
  • Content Labeling: You agree not to remove any automated watermarks or "Generated by AI" labels that our system attaches to Outputs.

5. Prohibited Conduct

You agree not to:

  • Use the App to generate deepfakes, non-consensual sexual content, or deceptive political materials.
  • Reverse engineer our AI models or "scrape" data from the App to train your own models.
  • Use the App to bypass the safety filters or "jailbreak" the underlying AI.

6. Mandatory Arbitration & Class Action Waiver

Please read this section carefully. It affects your legal rights.

  • Individual Arbitration: Any dispute arising from these Terms will be settled by binding, individual arbitration. You waive your right to a trial by jury.
  • Class Action Waiver: You agree that you may only bring claims against us in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
  • Mass Filing Protections: To prevent "mass arbitration" abuse (common in 2026), if 25 or more similar arbitration demands are filed against us within 30 days, the parties agree that the AAA/JAMS shall administer them in batches of 50 to ensure efficiency and fairness.

7. Limitation of Liability

To the fullest extent permitted by law, Bisaria LLC shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data, resulting from your use of the App or any AI-generated Output. Our total liability is limited to the greater of $10 or the amount you paid us in the last 12 months.
